Leno's lawyers say that he has a First Amendment right to free speech, so long as he does not "disclose evidence of which he may have direct, first-hand knowledge, assuming only for the sake of argument that any such evidence exists." The motion that was filed also requests that the process be expedited. Carrie Simons, a publicist for "The Tonight Show with Jay Leno", said Wednesday she could not comment on the matter because of legal concerns.
